1. SUBJECT

These general terms and conditions of sale are intended to define the rights and obligations of R-PUR and the Customer of products presented by R-PUR S.A.S on its website www.r-pur.com/ (hereinafter "The Site"). They apply exclusively between R-PUR S.A.S., 24 avenue du repos 94270 Le Kremlin Bicetre, SIRET: 824 567 671 000 14 (hereinafter "R-PUR") and any individual consumer visiting or making a purchase via the said Site (hereinafter "the Customer"). 
On the Site, R-PUR allows the Customer to order R-PUR brand products (hereinafter "the Product(s)") online in accordance with these terms and conditions. 
Any order placed with R-PUR therefore implies the Customer's unreserved acceptance of these terms and conditions. These terms and conditions are subject to change at any time and without notice by R-PUR, the applicable terms and conditions being those in force at the date of the order by the Customer. 
The present general terms and conditions of sale are permanently accessible at the following address: 
https://www.r-pur.com/conditions in a computer format allowing their printing and/or downloading, so that the Customer can proceed to their reproduction or saving.

 

2. PRODUCTS AND CONFORMITY

2.1. The Products offered for sale are presented on the R-PUR website and accompanied by a description. 
2.2. The Products offered by R-PUR comply with the standards applicable in France. 
Elements such as photographs, text, graphics and all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges. 
Consequently, R-PUR cannot be held liable in the event of error or omission of any of these elements or in the event of modification of these elements by suppliers and/or publishers. 
2.3 Certain products or services may be available exclusively online on the Website. These products or services may be in limited quantities and are subject to return or exchange only in accordance with R-PUR's return policy. 
R-PUR strives to display the colors and images of R-PUR products as accurately as possible. R-PUR cannot guarantee that the color displayed by the Customer's computer screen will be accurate. 
2.4. R-PUR reserves the right, but not the obligation, to limit sales of its Products to any person, geographic region or jurisdiction. R-PUR may exercise this right on a case-by-case basis. 
2.5. R-PUR reserves the right to limit the quantities of Products offered and to discontinue any purchase at any time. Any descriptions or prices of Products may be changed at any time and without notice at R-PUR's sole discretion. 
2.6. R-PUR does not warrant that the quality of Products, services, information or other material purchased or obtained by the Customer will meet its expectations, or that any errors in service will be corrected.


3. OBLIGATIONS OF THE CLIENT

3.1. The Customer declares to be at least 18 years old and to have the legal capacity or to hold a parental authorization allowing him to make an order on the Site. 
3.2. The Customer undertakes to communicate to R-PUR the actual and necessary information required for the performance of the service subject to these terms and conditions as requested online and according to his situation, including his name, address, telephone number and valid e-mail. 
The Client is responsible for the consequences resulting from false or inaccurate information transmitted or whose resumption would be illicit. 
3.3. Once the order has been placed, R-PUR will send the Customer an e-mail confirming the order. It informs him/her of the sending of the Products. 
3.4. The Customer can modify his data in the section "my account".

 

4. ORDER

4.1. Any order will be validated only after acceptance of payment. 
4.2 R-PUR reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order. 
4.3. R-PUR may accept orders within the limits of available stocks. It informs the Customer of the availability of the Products sold on the Site at the time of order confirmation. 
If, despite the vigilance of R-PUR, the products are unavailable, R-PUR will inform the Customer by e-mail as soon as possible. The Customer may then cancel his order and be reimbursed, if necessary, the sums already paid. 
R-PUR shall not be held liable for any permanent or temporary unavailability, nor shall it give rise to any right to compensation or damages in favour of the Customer. 
4.4. The number of Products purchased per order is limited. This limit is 5 masks and 30 filters per order. R-PUR reserves the right to refuse any order.

4.5. The order of Products must not under any circumstances be intended for resale of any kind. R-PUR reserves the right to cancel any order placed for this purpose and to refuse to deliver to the Customer in future orders. 

4.6. Any Business Customer wishing to negotiate a "business" rate shall inform R-PUR prior to placing an order.

 

5. PRICE

5.1. The prices displayed on the Site are indicated in euros, including all French taxes (French VAT and other taxes that may be applicable), excluding shipping costs and promotional codes. 
The shipping costs, known as "Delivery", will be indicated in the Customer's basket, before the final validation of the order. 
The promotion code, delivered by R-PUR on an exceptional and punctual basis, must be inserted before the final validation of the order. 
5.2. The prices of R-PUR products are subject to change without notice. 
R-PUR reserves the right, at any time, to modify or discontinue the service (or any part thereof) without notice. 
R-PUR shall not be liable to third parties for any price changes, suspension or discontinuance of the service. 
5.3. R-PUR may offer a "business" rate to any Business Client wishing to equip its staff. R-PUR reserves the right to refuse the negotiation of a corporate rate without any liability on the part of R-PUR, nor shall it give rise to any right to compensation or damages in favour of the Corporate Client.


6. DELIVERY

6.1. R-PUR delivers its Products by Colissimo and Chronopost throughout France, and can deliver abroad on request. If the country concerned does not appear in the list of countries at the time of the order, then this country is not deliverable. 

The products are shipped with the delivery note, to the delivery address indicated by the Customer when placing the order. The address indicated must be within the possibility of receiving packages. The delivery times indicated on the site are there as an indication, corresponding to the average processing and delivery times. In order for these deadlines to be respected, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as: street, building, staircase number, access codes, names and/or intercom numbers, email, telephone number, etc.). 
In the event of a delay in delivery of more than 15 days, if the product has not been dispatched, the Customer may cancel the order by registered letter with acknowledgement of receipt and request a refund of his order. 
If the item has been shipped before receipt of the cancellation of the order for delivery delay of more than 15 days, R-PUR will proceed to refund the item and the shipping and return costs, upon receipt of the item, complete, in its original condition and with all labels. 
R-PUR undertakes to inform the Customer of the progress of the processing of his order. 
In case of damaged packages (already opened, missing products...), the Customer undertakes to notify the carrier and R-PUR, by any means, all reserves within 3 days of receipt of the product. 
R-PUR will not be held responsible for any consequences due to a delay in delivery that is not its fault. 
6.2. R-PUR reserves the right to offer delivery charges on specific and punctual periods. Outside the period specified at the time of ordering on the Site, the customer can not request an exemption from delivery charges.

 

7. PAYMENT

Full payment must be made at the time of ordering. At no time can the sums paid be considered as a deposit or advance payment. The Customer pays for his order by credit card (Visa, Mastercard, American Express), with his Paypal account or via Apple Pay in accordance with the provisions of this article. 
For any transaction, the Customer shall indicate the number appearing on the front of his card, the expiry date of his card and the cryptogram appearing on the back of his card (last three digits). 
The communication by the Customer of his credit card number authorizes R-PUR to debit his account up to the amount of his order. 
No cash on delivery will be accepted for any reason whatsoever. 
R-PUR retains ownership of the item until full payment of the price by the Customer. Purchases are made in a secure manner. The payment solutions adopted by R-PUR are 100% secure. For credit card payments, all information that Customers communicate to R-PUR is strictly protected and guarantees the conformity and security of each transaction.

 

8. RETURNS AND REFUND OF PRODUCT(S)


CANCELLATION PERIOD 
Within thirty (30) days from receipt of the order, the Customer may request R-PUR to return the Product(s). After this period, R-PUR will be unable to make a refund or exchange. 
Items on sale will not be refunded. R-PUR filters, considered as intimate or hygienic goods, will not be refunded or exchanged when ordered individually and not in the mask when originally purchased.


6.1. For any refund, the Customer must contact R-PUR by the designated forumaire at https://help.r-pur.com/ following which, after approval or rejection by email of the refund by R-PUR, a return slip will be generated. For the refund request to be eligible, the Customer must return by mail the Product in its original packaging, in its original condition, unwashed and accompanied by the receipt or proof of purchase.

Under no circumstances should the return be made directly to the manufacturer. 
In the case of an exchange, only defective or damaged items may be exchanged. 
6.2. From France, the shipping costs of the Product are paid by R-PUR. 
In the case of a return from a country other than France, the Customer will have to return the Product(s) at his own expense except in the case where he would have received a product with a manufacturing defect or not corresponding to the Customer's initial order. 
The designation of the offending party in order to attribute the payment of the return costs will have to be analysed and determined by R-PUR on a case-by-case basis. 
The return is at the Customer's risk. 
The returned Product will be credited or refunded within a maximum of twenty (20) days from receipt by R-PUR. In the case of a refund, this will be made by crediting the amount to be refunded to the Client's bank account. 
If the Customer fails to comply with these terms and conditions, in particular the conditions of return or exchange, R-PUR will not be able to proceed to the refund of the Products concerned.


9. PRE-ORDER

9.1. Pre-order periods may take place on an ad hoc and/or temporary basis, without prior notice and without a fixed time limit. 
In the case of a pre-order, the conditions set out below shall apply to points 4. Order, 5. Prices, 6. Delivery and 7. Payment. 
9.2. No deadline or delivery date can be taken into account in an exhaustive way. The announced delivery times are only indicative and determined on an estimated basis. 
However, R-PUR remains under the obligation to keep Clients informed of the progress of the project and any delays in the estimated deadlines. 
9.3. Deliveries of pre-orders will be made in order of priority of purchase of the Clients. 
9.4. R-PUR reserves the right to offer a discount code during a pre-order period. This code, created solely for this purpose, cannot be applied once the pre-order period has ended. 
9.5. Apart from the modifications stated above, the other conditions remain valid and binding.

 

10. INTELLECTUAL PROPERTY

Under no circumstances is the Customer authorised to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, etc.). 
This Site or any part of this Site may not be reproduced, copied, sold or exploited for commercial purposes without the express written permission of R-PUR. 
In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site, will remain the full and entire property of R-PUR. 
The Client is therefore bound to respect the intellectual property rights and may not use the trademarks appearing on the Website and on the Products, if any, or register any trademark that would be prejudicial to the holder of the rights, unless otherwise contractually agreed. 
The same applies to any other intellectual property rights.

 

11. GUARANTEES AND LIABILITY

R-PUR has, for all stages of access to the Site, from the order process to the shipment of the package or subsequent services, only an obligation of means. R-PUR cannot be held liable for any inconvenience or damage inherent to the use of the Internet network, including but not limited to a break in service, external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and case law.

R-PUR undertakes to use the confidential information of Customers only in the context of the operation of its Site. 
For the good progress of the order, the personal data collected will be the subject of a data-processing treatment, the Customer acknowledges having knowledge of it. 
As such, information concerning him/her may be communicated to technical service providers of R-PUR. 
In addition, R-PUR may apply technical means to obtain non-personal information relating to Internet users and intended to improve the functionality of the site, for example by tracking the number of visitors to certain pages. 
In accordance with the law of January 6, 1978 amended by the law of August 6, 2004, the Client has the right to access and rectify personal data concerning him/her in R-PUR's files. 
This data processing has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL) which issued the receipt n° 1517135 v 0 on June 29th 2011.

 

12. MAJOR FORCE

In the event of the occurrence of an event of force majeure, the party concerned must inform the other party within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgement of receipt. 
Expressly, are considered as force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of the French courts and tribunals, total or partial strikes, lock-outs, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer failure, blockage of telecommunications, including wired or wireless telecommunications networks, and any other cases beyond the control of the parties that prevent the normal execution of the contractual relationship. 
All the obligations of the parties are suspended for the entire duration of the force majeure event, without compensation. 
If the event of force majeure lasts for more than three (3) months, the contract concerned may be terminated by operation of law without compensation for either party.

 

13. GENERAL PROVISIONS


13.1. PARTIAL INVALIDITY OF A CLAUSE 
If any of the stipulations of the present conditions is declared null and void or unenforceable by a competent court, it will be declared unwritten and will not lead to the nullity of the other stipulations. 
13.2. UPDATE 
These terms and conditions may be modified at any time and without notice by R-PUR, the applicable conditions being those in force at the date of the order by the Customer.

13.3. APPLICABLE LAW - COMPETENT COURT 
The present general conditions are subject to French law with regard to both substantive and formal rules. Any dispute shall be subject to a prior attempt at amicable settlement. 
In the absence of an amicable settlement, jurisdiction is attributed to the competent French courts, notwithstanding plurality of defendants or appeal in warranty. 
13.4 : REPRODUCTION OF APPLICABLE TEXTS (ORDER 2005-136 OF 17 FEBRUARY 2005, CONSUMER CODE, CIVIL CODE) 
Art. L. 211-4. of the Consumer Code 
The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation, if the latter was made by him under the contract or was carried out under his responsibility. 
Art. L. 211-5. of the Consumer Code 
- To be in conformity with the contract, the property must: 
(1) Be fit for the use ordinarily expected of similar property and, where appropriate: 
- correspond to the description given by the seller and possess the qualities that the seller has presented to the Customer in the form of a sample or model; 
- present the qualities that a Customer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling; 
2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the Customer, brought to the seller's attention, or be suitable for any other special use sought by the Customer, brought to the seller's attention, or be suitable for any other special use sought by the Customer.

Art. L. 211-12. of the Consumer Code 
Any action resulting from lack of conformity shall be time-barred after two years from the date of delivery of the goods. 
Article 1641 of the Civil Code 
The seller is bound by the guarantee on account of hidden defects in the item sold which render it unfit for the use for which it is intended, or which so diminish this use that the Customer would not have acquired it, or would have paid a lower price for it, if he had known about them. 
Article 1648, paragraph 1 of the Civil Code 
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
